The rules and guidelines for using Trackberry

Agreement to Terms

By accessing or using Trackberry's shipment visibility platform (the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Description of Service

Trackberry provides a cloud-based platform for fresh produce importers, including:

AI-powered document processing
Container tracking & ETAs
Shipment data aggregation
Quality & compliance checks

Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

Subscription & Payment

Free Trial

We offer a 14-day free trial for new accounts. No credit card is required during the trial period.

Paid Plans

After the trial, continued use requires a paid subscription. Fees are billed monthly or annually in advance.

Each plan includes a specified number of containers. Additional containers are billed at your plan's per-container rate.

Refunds

Subscription fees are non-refundable, except where required by applicable law. You may cancel at any time and retain access until the end of your billing period.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service's infrastructure
  • Upload malicious code or content
  • Resell or redistribute the Service without authorization
  • Use the Service to process data unrelated to shipment management

Your Data

Ownership

You retain all rights to your data. We only use it to provide the Service.

Data Processing

For data you upload, we act as a data processor. See our Data Processing Agreement.

Security

We implement appropriate measures to protect your data. See our Privacy Policy.

Intellectual Property

The Service, including its software, design, and content, is owned by Trackberry and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

Third-Party Services

The Service integrates with third-party services (e.g., container tracking APIs, email providers). Your use of these services is subject to their respective terms and privacy policies.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

While we strive for accuracy in document processing and container tracking, we do not guarantee the accuracy of extracted data or ETA predictions. You remain responsible for verifying critical shipment information.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKBERRY'S LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Indemnification

You agree to indemnify and hold Trackberry harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Term & Termination

Term These Terms remain in effect until terminated by either party.
Termination by You Cancel anytime through account settings or by contacting support.
Termination by Us We may terminate with 30 days' notice, or immediately for serious violations.
After Termination Export your data within 30 days. After that, data is deleted per our Privacy Policy.

Modifications

We may modify these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Your continued use after changes become effective constitutes acceptance.

Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Málaga, Spain.

General Provisions

  • Entire Agreement These Terms, together with our Privacy Policy and DPA, constitute the entire agreement.
  • Severability If any provision is unenforceable, the rest remain in effect.
  • Waiver Failure to enforce any provision does not constitute a waiver.
  • Assignment You may not assign your rights without our consent.
